Terms and Conditions – DJ Andy Richardson

These Terms & Conditions apply to bookings made with DJ Andy Richardson for mobile DJ,
wedding disco and related entertainment services.
By making a booking, the Client confirms that they have read and accepted these Terms & Conditions.
For the purposes of these Terms & Conditions, “DJ Andy Richardson”, “Andrew Richardson”, “DJ”, “I” and “me” refer to Andrew Richardson, trading as DJ Andy Richardson. “Client” refers to the person or persons making the booking. “Event” refers to the event or events covered by the Booking Confirmation, and “Event Date” refers to the date on which the services are due to be provided.
1. Booking & Contract
1.1 A booking is confirmed once the required Booking Form has been completed and the agreed deposit has been received.
1.2 A Booking Confirmation will then be issued to the Client by email. A signature is not required unless specifically requested.
1.3 The Booking Confirmation, these Terms & Conditions and any written amendments agreed by email form the contract between the Client and DJ Andy Richardson.
1.4 The Client is responsible for checking the Booking Confirmation and notifying DJ Andy Richardson promptly of any errors, omissions or changes required.
1.5 Additional services or significant changes to an existing booking must be agreed in writing. Where appropriate, an updated Booking Confirmation will be issued showing the agreed changes and any additional fees.
2. Booking Information & Personal Data
2.1 Information supplied by the Client will be used to administer the booking, communicate with the Client and provide the agreed services.
2.2 Personal information will be stored securely and handled in accordance with the DJ Andy Richardson Privacy Policy.
2.3 Personal information will not be sold or provided to third parties for their own marketing purposes.
2.4 Information may be shared with a Venue, supplier or other relevant third party where reasonably necessary to provide the services, where requested by the Client, or where required by law.
2.5 Booking information may be retained for as long as reasonably necessary for business administration, accounting, tax, legal and record-keeping purposes.
3. Payments
3.1 The agreed deposit secures the booking.
3.2 Deposits may normally be paid by PayPal, BACS or cash where agreed.
3.3 Interim payments may be arranged for longer bookings. Updated Booking Confirmations may be issued following receipt of payments.
3.4 Unless otherwise agreed, the final balance must be paid by BACS no later than five working days before the Event Date.
Alternatively, where agreed in advance, payment may be made in cash on the Event Date. If paying by cash, payment is requested in full before DJ Andy Richardson starts the performance.
3.5 If any payment remains outstanding on the Event Date, DJ Andy Richardson reserves the right not to travel to the Venue or provide the services. The Client will be notified by email and text message as soon as reasonably possible.
3.6 Corporate, Venue or other business bookings may have different payment arrangements, including payment after the Event or after a block of Event Dates, where agreed in writing.
3.7 If a payment remains outstanding, DJ Andy Richardson will make reasonable efforts to contact the Client to resolve the matter. If the payment remains outstanding and no alternative arrangement has been agreed, DJ Andy Richardson reserves the right, subject to applicable law, to decline to provide the services.
3.8 Discounted or Complimentary Bookings. Where DJ Andy Richardson agrees to provide services at a reduced fee, discounted rate or without charge, the Booking Confirmation may show the normal value of the services together with the agreed discount. If the Client cancels the booking other than in circumstances covered by the Force Majeure provisions, the cancellation provisions in Section 4 will be applied having regard to the actual agreed booking fee and the circumstances of the cancellation. Where appropriate, DJ Andy Richardson may take the value of the agreed discount into account when calculating any amount reasonably due following cancellation.
(Nothing in this clause is intended to create a disproportionate charge or to override any rights the Client may have under applicable law).
4. Client Cancellation
4.1 The Client may cancel a booking at any time. Cancellation should be made in writing, preferably by email.
Because the Event Date has been reserved specifically for the Client, cancellation may result in financial loss, lost booking opportunities and costs incurred by DJ Andy Richardson.
4.2 Where a Client cancels for reasons other than a Force Majeure Event, the following cancellation scale will normally apply:

More than 91 days before the Event Date: no further balance normally payable.

90 to 61 days before the Event Date: up to 50% of the booking fee may be payable.

60 to 31 days before the Event Date: up to 75% of the booking fee may be payable.
-
30 days or less before the Event Date: up to 100% of the booking fee may be payable.
4.3 The amount retained or charged will take account of the circumstances of the cancellation, payments already made, costs incurred and the reasonable opportunity available to resell the Event Date.
4.4 If the cancelled Event Date is successfully rebooked by DJ Andy Richardson at an equal or higher fee, no remaining balance will normally be due from the original Client.
4.5 If the date is successfully rebooked at a lower fee, any remaining amount will be considered having regard to the difference in fees and losses reasonably arising from the original cancellation.
4.6 The cancellation provisions are intended to provide reasonable compensation for losses arising from cancellation and are not intended to operate as an unfair or disproportionate penalty.
4.7 Any cancellation fees agreed or reasonably due should normally be paid within 28 days of the original Event Date unless otherwise agreed.
4.8 Nothing in this Section prevents the Client from exercising any statutory rights available to them.
5. Transfer of a Booking
5.1 If the Client needs to change the Event Date rather than cancel the booking, DJ Andy Richardson will make reasonable efforts to transfer the booking to another date.
5.2 The new date is subject to availability and will normally be within 365 days of the original Event Date.
5.3 A transfer cannot be guaranteed. If DJ Andy Richardson is unavailable on the requested new date, the booking will be treated as a Client cancellation and the cancellation provisions in Section 4 will apply.
5.4 Any agreed change of Event Date must be confirmed in writing.
5.5 Changes to Venue or Event Location. The Client must notify DJ Andy Richardson as soon as reasonably possible of any proposed change to the Venue or Event Location, including any change of room within the same Venue. A change of Venue or location may result in additional charges where it significantly increases travel, loading, unloading, parking, access or set-up requirements. Any additional charge will be agreed with the Client before the change is accepted. DJ Andy Richardson reserves the right to decline a change of Venue where the alternative location presents unreasonable access, loading, safety or equipment-related difficulties.
5.6 Changes to Event Requirements. Any significant change to the Event, including changes to the Venue, room, performance area, performance times or services required, must be agreed with DJ Andy Richardson in advance.
DJ Andy Richardson cannot be held responsible for difficulties arising from changes that have not been notified or agreed in advance.
6. Force Majeure
6.1 Neither party will normally be responsible for failure to perform their obligations where this is caused by circumstances that are reasonably outside their control.
6.2 Examples may include serious illness, accident, severe weather, fire, flood, power failure, government restrictions, civil emergency, industrial action, transport disruption or circumstances which make performance impossible or unsafe.
6.3 Where a booking cannot reasonably be performed because of a Force Majeure Event, DJ Andy Richardson and the Client will discuss reasonable options, which may include rearrangement or refund where appropriate.
6.4 Where a Force Majeure Event affects the original Event Date and the booking is transferred to another date, any transfer will remain subject to DJ Andy Richardson's availability.
7. Venue Requirements & Event Schedule
7.1 The Client is responsible for ensuring that the Venue permits the agreed entertainment and that all relevant permissions, licences and restrictions are in place.
7.2 The Client must notify DJ Andy Richardson of any Venue restrictions affecting music, sound levels, lighting, haze, strobe lighting, confetti, access, parking, set-up or performance times.
7.3 Where a Venue has a sound limiter or other sound restriction, DJ Andy Richardson will make reasonable efforts to work within the permitted level but cannot guarantee a particular volume where this is restricted by the Venue.
7.4 DJ Andy Richardson is not responsible for Venue restrictions or the Venue's failure to provide suitable facilities.
7.5 If late commencement or overrunning of formalities such as wedding speeches, presentations or other scheduled activities, or changes made by the Client or Venue staff through no fault of DJ Andy Richardson, prevent the performance from starting at the agreed time, no refund or reduction will normally be due.
7.6 If the Event starts late for reasons outside DJ Andy Richardson's control, DJ Andy Richardson reserves the right to finish at the contracted finish time shown on the Booking Confirmation. DJ Andy Richardson is not obliged to extend the performance and no additional time will be provided without prior agreement.
8. Access, Set-Up & Performance Area
8.1 The Client is responsible for ensuring that suitable and safe access is available for DJ Andy Richardson to deliver, set up, operate and remove his equipment.
8.2 The Performance Area must be reasonably suitable, dry, stable, level where reasonably possible, free from hazards and large enough to accommodate the equipment required for the booking.
8.3 As a general minimum requirement, DJ Andy Richardson requires a clear floor area of approximately 3 metres by 1.5 metres, with a minimum clear height of approximately 2 metres. Larger areas may be required depending on the equipment or services booked.
8.4 Adequate electrical power must be available close to the Performance Area. Unless otherwise agreed, this should normally consist of a suitable twin 13A supply or single 16A supply, located within approximately 20 metres of the equipment.
8.5 Where the Event is held in a marquee, tipi or other temporary structure, the Client is responsible for ensuring that the structure, flooring, access and electrical supply are suitable and safe for the equipment and services being provided.
8.6 Where electrical power is supplied by a generator, the Client must notify DJ Andy Richardson before the Event Date and ensure that the generator provides a suitable, stable and clean electrical supply of adequate capacity.
8.7 The Client should inform DJ Andy Richardson in advance of any stairs, restricted access, long carrying distances, difficult loading areas, unusual access arrangements or other circumstances that may affect delivery or set-up.
8.8 DJ Andy Richardson will carry out a reasonable assessment of the Performance Area and surrounding conditions on arrival. If the area or conditions are considered unsafe, equipment will not be set up or operated until a reasonably safe solution has been identified.
8.9 DJ Andy Richardson may temporarily suspend or permanently stop the performance if circumstances during the Event create a genuine risk to people, equipment or property.
8.10 Where a suitable and safe solution cannot be found because of circumstances relating to the Venue, Client or Event location, DJ Andy Richardson will liaise with the Client and/or Venue staff where reasonably possible, but cannot accept responsibility for resolving deficiencies that are the responsibility of the Client or Venue.
9. Equipment & Venue Equipment
9.1 DJ Andy Richardson will provide professional sound, lighting and other equipment appropriate to the services booked.
9.2 All equipment remains the property of DJ Andy Richardson or the relevant equipment provider.
9.3 Clients, guests and third parties must not operate, move, disconnect, adjust or interfere with equipment without permission.
9.4 Where equipment is damaged by the Client or a guest through misuse, deliberate action or unreasonable behaviour, the Client may be responsible for reasonable repair or replacement costs, subject to applicable law.
9.5 DJ Andy Richardson is not responsible for the condition, operation or failure of Venue or third-party equipment.
9.6 If a Venue requires DJ Andy Richardson to use its own sound system or other equipment, DJ Andy Richardson cannot guarantee its performance or reliability and reserves the right to refuse equipment that is unsuitable, unreliable or unsafe.
9.7 Use of Equipment by Other Persons. No Client, guest, performer or other third party may operate, move, disconnect, adjust or otherwise use DJ Andy Richardson's equipment without his prior permission. Where another performer or artist is expected to use or connect to DJ Andy Richardson's equipment, this must be discussed and agreed with DJ Andy Richardson in advance. DJ Andy Richardson reserves the right to refuse the use of his equipment by another person where he considers the proposed use to be unsafe, unsuitable or likely to damage the equipment.
10. Client & Guest Behaviour
10.1 The Client is responsible for the behaviour of their guests.
10.2 DJ Andy Richardson operates a zero-tolerance approach to threatening, abusive, violent or seriously disruptive behaviour.
10.3 Where there is a genuine risk to personal safety, equipment or property, DJ Andy Richardson may temporarily stop the music or, where necessary, terminate the performance and/or leave the Venue.
10.4 Where a bar is self-service or alcohol is being provided by the Client rather than a professionally managed bar, the Client is responsible for ensuring that alcohol is served responsibly and that a responsible adult is available to deal with any issues.
10.5 Normally, no refund will be due where the performance is stopped because of serious or unsafe behaviour by the Client or guests.
10.6 Children & the Performance Area. Whilst DJ Andy Richardson takes reasonable steps to ensure that his equipment and Performance Area remain safe throughout the Event, he is not responsible for the welfare or supervision of guests or guests' children who enter the Performance Area without permission. The Client and, where appropriate, the parents or guardians of children attending the Event, are responsible for ensuring that guests and children do not enter the Performance Area, interfere with, play with or otherwise tamper with the DJ equipment. If children enter the Performance Area, attempt to play with or interfere with the equipment, or cause damage to any equipment, DJ Andy Richardson will raise the matter with the Client, who will be responsible for resolving the situation. If guests or children continue to enter the rear or general Performance Area after the matter has been raised, DJ Andy Richardson reserves the right to temporarily suspend the music until the situation has been resolved and the Performance Area can be considered safe. DJ Andy Richardson cannot be held responsible for injury, loss or damage arising from guests or children entering the Performance Area without permission or interfering with the equipment, subject always to applicable law.
10.7 Venue Rules & Guest Behaviour. DJ Andy Richardson will reasonably assist Venue staff with appropriate announcements or requests relating to guest behaviour, such as asking guests not to take drinks on the dance floor or requesting that doors or windows remain closed where necessary to contain sound. Such assistance does not make DJ Andy Richardson responsible for supervising guests or enforcing Venue rules. DJ Andy Richardson will not accept contractual liability imposed by a Venue for the behaviour of guests and will not be required to sign a separate disclaimer or agreement accepting such liability. The Client is responsible for checking with the Venue before the Event Date whether any such agreement or requirement applies. If a Venue refuses to allow DJ Andy Richardson to perform because he is unable or unwilling to sign such an agreement, the booking may be treated as a Client cancellation and the cancellation provisions in Section 4 will apply.
11. Music & Performance
11.1 DJ Andy Richardson will make reasonable efforts to accommodate the Client's musical preferences and requests.
11.2 Clients may provide playlists, must-play lists and do-not-play lists in advance.
11.3 DJ Andy Richardson retains artistic discretion over the order, timing and presentation of music in order to respond to the atmosphere and audience.
11.4 Providing a playlist does not guarantee that every track will be played.
11.5 No DJ can guarantee that every guest will dance or that every musical preference will be satisfied. DJ Andy Richardson will nevertheless aim to provide an engaging, professional and enjoyable service.
11.6 First Dances and Special Songs
Where the Client requests a specific first dance, special song or particular version of a recording, the Client is responsible for providing the correct song title and, where relevant, the specific version required.
DJ Andy Richardson will make reasonable efforts to source requested recordings. However, if a particular recording or version is not commercially available or cannot reasonably be obtained, DJ Andy Richardson cannot guarantee that it will be available for playback. Where the Client has a recording that is not commercially available, the Client should provide that recording to DJ Andy Richardson before the Event Date.
11.7 Explicit or Potentially Offensive Content. DJ Andy Richardson will make reasonable efforts to use clean or radio-edit versions of songs where appropriate.
The Client should advise DJ Andy Richardson before the Event Date if explicit lyrics, occasional swearing or particular types of content are not acceptable for their Event.
DJ Andy Richardson retains reasonable artistic discretion over whether a particular song or recording is suitable for the Event, taking account of the audience, Venue and circumstances.
DJ Andy Richardson may decline to play a song where he reasonably considers that it is likely to cause serious offence or create an inappropriate situation.
11.8 Client Playlists. Where the Client provides a playlist, DJ Andy Richardson will make reasonable efforts to incorporate it into the performance. However, DJ Andy Richardson retains artistic discretion over the order, timing and selection of tracks in order to respond to the atmosphere and audience.
11.9 Where a playlist is considered wholly unsuitable for the Event or would make it impracticable to provide a professional DJ service, DJ Andy Richardson will discuss the matter with the Client and may decline to follow the playlist in full.
12. Extended Performance Fees
12.1 If the Client wishes to extend the agreed finish time on the Event Date, this can only take place if DJ Andy Richardson agrees. An additional “On the Day” charge of £50 per full or part hour will apply. Payment must be made before the additional time begins.
12.2 The amount of additional time must also be agreed with the Venue Management before the extension begins.
12.3 If Venue Management subsequently changes its decision and the extension is no longer permitted, payment will be reimbursed for any full additional hours only. Payments relating to a part-hour will be non-refundable.
12.4 DJ Andy Richardson reserves the right to refuse any request to extend the performance.
13. Third-Party Suppliers
13.1 DJ Andy Richardson may recommend or work alongside photographers, videographers, Venues, caterers, entertainers or other suppliers.
13.2 Unless separately contracted by DJ Andy Richardson, such businesses are independent suppliers and are responsible for their own services.
13.3 DJ Andy Richardson is not responsible for the acts, omissions, equipment, delays, failures or performance of independent third-party suppliers.
14. Selfie Magic
14.1 Where Selfie Magic is included in the booking, it is provided as an informal entertainment feature and is not intended to replace the services of a professional photographer or videographer.
14.2 Selfie Magic relies on guests choosing to participate and submit photographs, videos or messages using their own phones or devices. DJ Andy Richardson cannot guarantee that guests will submit material or that a particular quantity or quality of material will be received.
14.3 Guests are responsible for the content they submit. Material must not be unlawful, abusive, defamatory, threatening, discriminatory or otherwise inappropriate.
14.4 Submitted material may be temporarily stored by the relevant service provider in order to provide the Selfie Magic service.
14.5 Not all photographs, videos or messages may be screened before being displayed during the Event. Where inappropriate material is identified, reasonable steps may be taken to prevent it being displayed.
14.6 Following the Event, submitted material may be made available to the Client through an online service for a limited period. Where approximately 14 days is stated for the relevant service, this period is subject to the service provider's availability and terms.
14.7 DJ Andy Richardson cannot guarantee the continued availability of photographs, videos or messages after the stated online availability period.
14.8 Further information concerning personal data and the handling of submitted material is contained within the DJ Andy Richardson Privacy Policy and, where applicable, the relevant Selfie Magic service provider's privacy information.
15. Photography, Video & Marketing
15.1 DJ Andy Richardson may photograph or record equipment, set-up, Venue atmosphere and the Event for business, promotional or social media purposes where appropriate.
15.2 Where identifiable Clients or guests are used in promotional material, appropriate permission or consent will be obtained where required.
15.3 A Client who does not wish identifiable images or recordings of themselves to be used for promotional purposes should notify DJ Andy Richardson before the Event.
15.4 No Client or guest is required to participate in promotional photography or video.
16. Replacement DJ
16.1 In exceptional circumstances, including serious illness, accident or circumstances beyond reasonable control, DJ Andy Richardson may be unable to attend personally.
16.2 Where reasonably possible, DJ Andy Richardson will arrange a suitably experienced replacement DJ.
16.3 Any replacement will be selected with reasonable regard to the nature and requirements of the Event.
16.4 If no suitable replacement can reasonably be arranged, the Client will be entitled to an appropriate refund for the affected service.
16.5 Nothing in this section limits any statutory rights the Client may have.
17. Delays & Travel
17.1 DJ Andy Richardson will make reasonable efforts to arrive at the Venue in sufficient time to unload and set up before the contracted performance time.
17.2 Reasonable allowance will be made for traffic, road closures, accidents, severe weather and other circumstances outside his control.
17.3 Where an unavoidable delay occurs, DJ Andy Richardson will communicate with the Client and/or Venue as soon as reasonably practicable where possible.
17.4 DJ Andy Richardson will make reasonable efforts to provide the contracted performance time where circumstances permit.
18. Power Failure & Other External Problems
18.1 DJ Andy Richardson is not responsible for interruptions caused by Venue electrical supply, sound limiters, Venue equipment, generators, infrastructure or other circumstances outside his reasonable control.
18.2 Where an interruption occurs, DJ Andy Richardson will make reasonable efforts to restore or continue the performance once the underlying problem has been resolved.
18.3 In the event of a total power failure affecting the Venue or the relevant part of the Venue, DJ Andy Richardson will not be responsible for any resulting interruption where the failure is outside his control.
18.4 Where power is unavailable for a significant part or all of the contracted performance period due to circumstances outside DJ Andy Richardson's control, no refund will normally be due, subject to applicable law.
19. Sound Levels, Lighting & Effects
Venue requirements, restrictions and permissions should be confirmed by the Client directly with the Venue's event or management staff before the Event Date. The Venue will be able to advise the Client of any specific requirements.
19.1 Sound Levels. DJ Andy Richardson will endeavour to maintain sound levels that are acceptable to the Venue Management. If the Client considers the sound level unsuitable or wishes the volume to be increased, it is the Client's responsibility to liaise with Venue Management. DJ Andy Richardson will not sign a third-party agreement or additional contract relating to sound levels or Venue-specific requirements. The Client should ask the Venue at the time of booking whether any such agreement exists and whether DJ Andy Richardson is required to sign it. If a Venue requires such a signature and DJ Andy Richardson is unable or unwilling to sign the agreement, and the Venue consequently refuses to permit the performance, the booking may be treated as a Client cancellation and the provisions of Section 4 will apply.
19.2 Sound Limiters. The Client must inform DJ Andy Richardson before the Event Date if a sound limiter is installed at the Venue and, where possible, obtain information regarding the permitted level from Venue staff.
DJ Andy Richardson is not responsible for poor or interrupted performance where a sound limiter repeatedly cuts power or the permitted sound level is too low to provide the expected performance.
19.3 Venue Sound Systems. The Client must inform DJ Andy Richardson if the Venue stipulates the use of an in-built or Venue-provided sound system. DJ Andy Richardson reserves the right to refuse to use equipment that he reasonably considers unsuitable, unreliable or unsafe.
19.4 Strobe Lighting. DJ Andy Richardson does not normally use traditional strobe lights. However, some lighting fixtures may be capable of producing a strobe effect.
The Client must inform DJ Andy Richardson before the Event Date if strobe effects are not permitted or are not to be used. DJ Andy Richardson cannot be held responsible for the use of a strobe effect where he has not been informed of the restriction or request.
19.5 Haze. Haze is a fine mist used to enhance disco lighting and is not the same as a traditional smoke machine. Where the Client requests haze, its use remains subject to Venue approval. DJ Andy Richardson is not responsible if the Venue refuses permission for haze or if third-party actions, Venue systems or alarms respond to the use of haze.
19.6.1 Confetti & Confetti Cannons. Where included in the booking, DJ Andy Richardson may provide handheld compressed-air confetti cannons. The Client is responsible for confirming with the Venue before the Event Date that confetti and/or confetti cannons are permitted. DJ Andy Richardson cannot be held responsible for the Venue refusing permission for confetti or confetti cannons, or for any restrictions imposed by the Venue.
19.6.2 Confetti may stain clothing, furnishings or other surfaces, particularly if it becomes wet. The Client accepts responsibility for any cleaning or damage arising from the use of confetti, except where caused by DJ Andy Richardson's negligence or other liability that cannot legally be excluded.
20. Liability
20.1 DJ Andy Richardson will provide the contracted service with reasonable care and skill.
20.2 Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights.
20.3 Subject to 20.2, DJ Andy Richardson will not be responsible for indirect or consequential losses that were not reasonably foreseeable.
20.4 Subject to applicable law, where DJ Andy Richardson is responsible for an inability to provide the contracted service, liability will normally be limited to the amount actually paid for the affected service.
20.5 Nothing in these Terms & Conditions is intended to reduce or remove any statutory rights available to consumers.
21. Complaints
21.1 Any concern or complaint should be raised with DJ Andy Richardson as soon as reasonably possible so that an opportunity is available to investigate and, where appropriate, resolve the matter.
21.2 Complaints should preferably be submitted in writing by email and contain sufficient information to allow the matter to be properly investigated.
21.3 All complaints will be considered fairly and DJ Andy Richardson will aim to provide a reasonable response within a reasonable timeframe.
22. Governing Law & Jurisdiction
22.1 These Terms & Conditions are governed by the laws of Scotland, except where mandatory consumer protection law provides otherwise.
22.2 Nothing in these Terms & Conditions affects any mandatory rights or protections available to consumers.
22.3 Subject to the above, the Scottish courts will have jurisdiction in relation to disputes arising from these Terms and Conditions or the associated contract.
23. General
23.1 Severability. If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
23.2 No Waiver. A failure or delay by DJ Andy Richardson in enforcing any provision of these Terms & Conditions will not amount to a waiver of that provision or any other provision.
23.3 Entire Agreement. These Terms & Conditions, the Booking Confirmation and any written amendments agreed between the parties form the agreement relating to the booking.
23.4 Updates to Terms & Conditions. DJ Andy Richardson may update these Terms & Conditions from time to time. The version applicable to a particular booking will normally be the version provided to or made available to the Client when the contract was formed, unless the parties subsequently agree otherwise in writing.
